Internet Junk Mail - SPAM

Servers will not be the source, intermediary, or destination address involved in the transmission of SPAM, flames or mail bombs. DomainMaker servers will not be listed in any spammed message, either as an originator, intermediary, or reply-to address. We define spam to be any mass unsolicited message or commercial in the mediums of email, fax, newsgroups, or web hosting.

Violation and spam will result in immediate termination of all services without refund, additionally theft of service fines or other legal action may be imposed. Any customer who is repeatedly flamed/mail-bombed or attracts such behavior will be asked to leave. DomainMaker reserves the right to determine if this policy is violated and to enforce penalties.

Intellectual Property Rights

Customers may not upload or transmit any message, data, images or programs that would violate the property rights of others, including unauthorized copyrighted text, images, music, or programs, trade secrets or other confidential proprietary information, or trademarks, service marks or trade names used in an infringing manner.

Inappropriate Material

DomainMaker servers will not host or handle material that contains nudity, pornography, obscenity, discriminatory/hate or threatening propaganda, "warez" related sites, or sites that promote the illegal distribution of software, or other illegal content. Result like video games using "Quick Server", "Heavy CGI-scripts" and "large SSI's" that cause an overload of DomainMaker servers are not allowed.

Pornography, pornographic advertising and sex-related merchandising are prohibited on DomainMaker servers. This includes sites that my infer sexual content, or link to adult content elsewhere. Sites that promote any illegal activity or content will be removed immediately. Links to such sites will result in the site being removed and the offending account will be closed.

Lawful Use

Customers may not use DomainMaker servers and capabilities to conduct or solicit the performance of any illegal activity or to conduct any other activity which infringes the rights of DomainMaker or any third party.

Sub-hosting

DomainMaker services are provided for end users only. Customer can sub host or resell any of the plans using any of DomainMaker's reseller programs with the users own domain name.

Payment

You agree to supply appropriate payment for the services received from DomainMaker, in advance of the time period during which such services are provided. You agree that all setup fees are non-refundable once setup is completed. You agree that if you are paying by credit card, prepayments will be billed and charged automatically, and that DomainMaker may apply the amount due to the provided card at any time.

Technical Support

DomainMaker offers 365-day, 24-hour server monitoring with all virtual server offerings. Technical support includes the following contact options:

Electronic Mail [Mon-Sun 24 Hours a day 7 days a week]
Voice Mail [Mon-Fri 9am to 10pm]
Office Hours [Mon-Fri 9am to 5pm]

Be aware that there is a difference between technical support and development support and training. Our service is geared towards Internet users that know how to use the tools they want to use to build their site. We expect our clients to participate in the technical support process, and pursue solutions to their problems without having to be spoon-fed by support technicians (at least for basic problems). Having said that, DomainMaker support is responsible for making sure that supported tools work as expected, and that the servers are stable. We are responsible for performing administrative tasks in a reasonable amount of time. Support personnel may also provide development support, but this is left to the judgement of each consultant. If you require training or custom programming, DomainMaker consultants are available at $30(US) per quarter hour. Our support personnel have consistently won praise for their technical skill and willingness to work with clients to solve problems. However, if you are signing up for our service expecting someone to call you and explain how to connect to the Internet and use FTP to move a file into a directory on the server, or help you with html pages, forms and/or outside software you may be disappointed.

Contract Length

DomainMaker bills in quarterly increments and requires a minimum three(3), six(6) or twelve(12) month contract. If you request 6 or 12 month prepaid discounted rates, then we do not offer a refund if you cancel you account before the contract ends. Customers can change from 3 or 6 months prepaid to 12 months prepaid at anytime, we will change your billing on the following billing cycle, please contact the DomainMaker billing office.

Cancellation

DomainMaker reserves the right to cancel service at any time. All fees paid in advance of cancellation may be pro-rated and paid by DomainMaker if DomainMaker initiates its right of cancellation. If cancellation is caused by a clientele's breach of these policies, then no refund is due. Clientele can cancel service any time and be refunded any amount that services have yet to be performed. Due to protection concerns, all account cancellations must be done in writing via US mail or fax with a valid signature of the principal contact of the account, account name and reason for revocation. Payment will be made by company check or credit card refund within 15 days of receipt of cancellation

DomainMaker denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by DomainMaker.
